But after much study, trial and error (and some struggles, of course), I managed to find a legal and viable path. And that's exactly what I'm going to share with you in this article, which I prepared as a true Living in the USA Legally: 2025 Guide.

Here, I'll tell you how to legally live in the United States in 2025, step by step, with everything I've learned from experience. Prepare your coffee (or tea) and join me!


Where to start? First, understand your goal.

First of all, you need to understand why Do you want to live in the USA? Work? Study? Quality of life? Escape from the neighbor who plays loud country music on Sundays? 😂 Whatever the reason, it will be your fuel, because the process requires planning and focus.

Therefore, the first step is to determine which type of visa best suits your needs. The main ones are:

H2B — Temporary Work Visa

Ideal for those who want to work legally in fields like hospitality, construction, or theme parks. This was my first visa!

Advantages:

  • Legalized from the start.
  • Possibility of annual renewal.
  • Safe entry into the country.

Disadvantages:

  • Requires a prior job offer.
  • It's temporary.

F1 — Student Visa

If your plan is to study, the F1 is perfect. It gives you the right to live legally during your course and, depending on the institution, work on campus.

Golden tip: many community colleges are cheaper and have international aid programs.

Green Card — The American Dream

Obtaining a Green Card is the path to permanent residency. There are several ways to obtain it, including:

  • Marriage to an American citizen (but, calm down, it’s not a fad… the government is smart!).
  • EB2-NIW visa (for skilled professionals).
  • Green Card Lottery (yes, it still exists!).
  • Sponsorship by company.

Step by step guide to legally living in the US in 2025

1. Choose the right visa

This step is primarily strategic. Analyze your background, experience, and life plans. And remember: tourist visa is not valid for living. Although many try, it is risky and can cause you serious problems with immigration.

2. Create a financial plan

Living abroad is expensive, especially in the beginning. So, plan ahead. Make a spreadsheet with:

  • Passport, visa, translation costs.
  • Airline ticket.
  • Reservation for the first 3 months.
  • Health insurance.
  • Housing and food costs.

Indeed, it was this step that saved my skin. I arrived with a reserve that supported me until I got my first job washing dishes in Orlando (I don't romanticize it, but it was worthy).

  • Financial evidence.
  • Letter of intent.
  • Employment contract (if applicable).

5. Master English

Absolutely, this can be a game-changer. Even if you're just cleaning floors, knowing how to communicate helps you:

  • Get better jobs.
  • Make friends.
  • Avoid trouble.

In fact, use apps like Duolingo, or better yet, watch videos on YouTube with subtitles. I learned a LOT listening to the American comedy podcast while washing dishes.

  • Never lie in a visa interview. Agents are trained to identify inconsistencies.
  • Avoid dubious intermediaries. I've seen people lose money with false promises.
  • Research the cost of living in the city where you intend to live. New York is a dream, but maybe Jacksonville or Austin make more sense to start with.
  • Join groups of Brazilians in the USA. They give precious tips, for example, where to rent, where to buy used furniture and even how to find jobs.
